LAWS, RULES, AND REGULATIONS

OF THE

Nebraska Soldiers' and Sailors' Home

ADOPTED BY

THE VISITING AND EXAMINING BOARD, JULY 2, 1895.

 

ARTICLE 1. The regular meetings of the Visiting and Examining Board shall be held at the home on the first Tuesdays of January, April, July, and October of each year.

ARTICLE 2. Special meetings of the Board may be called by the President when deemed advisable, or on request of three members of the Board.

ARTICLE 3. The Auditing Committee, consisting of three members of the Board, shall meet on the 25th day of each month and examine and approve all, bills and accounts, and when a bill is so approved it shall be certified to, by the President and Secretary.

ARTICLE 4. The President and Secretary, together with the Commandant of the home, shall constitute a committee to pass upon applications for admission.

ARTICLE 5. The President shall preside at all meetings of the Board and discharge such duties as usually belong to the office. In the absence of the President a President pro tempore shall be elected, who shall have the same duties and powers as the President.

ARTICLE 6. The Secretary shall keep correct minutes of the proceedings of the Board and perform such other duties as may appertain to the office.

THE COMMANDANT

    The Commandant shall reside at the Home and have charge of the premises, property, and members subject to the direction of the Visiting and Examining Board. He shall, with the consent of the Visiting and Examining Board, appoint all subordinate officers and employees, and assign them their respective duties, and with the consent, or on demand of said Board, discharge them from service. He shall see that all officers and employees faithfully discharge their duties, and shall be directly responsible to the Board for the economy, efficiency, and success of the management of said institution.

     The commandant shall carry on such farming operations upon the land belonging to the Home as he shall deem for the best interest of the institution and the members, and shall employ such labor, purchase such tools, feed, stock, and material, necessary to prosecute such farming operations, to the best advantage. He may dispose of any of the grain, stock, or other produce of the farm not needed in the Home to the best advantage, and use the funds so procured for the purchase of tools, seed, stock or material needed, and if there be any surplus he is also empowered to use it for any immediate repairs or incidental expenditures which may be required for the Home whenever the fund provided by the Legislature is expended, or is not available, or when no provision has been made. All vouchers for such expenditures to be first submitted at any regular or called meeting of the Board for their approval.

     It shall be the duty of the Commandant to fully inform the Visiting and Examining Board of all things connected with the management or discipline of the Home that should be known by them, and recommend in writing such changes as he may deem necessary for the welfare of the Home.

SUBORDINATE OFFICERS

     The subordinate officers of the Home shall consist of at Adjutant, Surgeon, and Matron. The Commandant may appoint such other assistants as may be deemed necessary, for the management of the Home, on approval of the Visiting and Examining Board.

SALARIES

     All salaries or compensations of officers, appointees, members, and employees of every class shall be fixed by the Visiting and Examining Board. 

ADJUTANT

     The Adjutant shall reside at the Home, and perform such duties as are required of both Adjutant and Quartermaster at military posts. He shall keep the following records on such forms as may be approved by the Commandant and the Visiting and Examining Board, viz.:

  • Application for admission.

  • Register of members containing complete history.

  • Register of deaths and burials.

  • Register of furloughs and passes.

  • Register of discharges.

     He shall make all reports in. regard to the members as may be required by the United States, the State of Nebraska, the Visiting and Examining Board, or the Commandant.

     It shall be his duty to take charge of and issue (under the direction of the Commandant or of rules adopted), all clothing and supplies of every kind, and keep an itemized statement of the amount and value of the same. Also cost per capita.

     He shall keep a correct: account of each fund belonging to the institution, showing all receipts,' from whatever source derived and all expenditures for whatever purpose used, find a true balance shall be made for each fund on the last day of each month.

SURGEON

     The Surgeon shall be legally licensed to practice medicine and surgery under the laws of Nebraska, and he shall reside at the Home.

     He shall examine every accepted applicant for admission to the Home and make a record of his condition and treatment upon a register to be kept for this purpose, and he shall give to every member discharged a sick card showing his condition and treatment while at the Nebraska Home.

     He shall have control of the hospital and everything pertaining to the members, including the diet.

     He shall attend to the medical and surgical treatment of every member of the Home. He shall make weekly examinations of all buildings and rooms occupied at the Home or connected therewith, also the condition of the grounds and the surroundings and report in writing to the Commandant, with suggestions in regard to the sanitary condition of the same, which report shall be placed on file in the office of the Adjutant for the inspection of the Visiting and Examining Board.

     He shall keep a record of all property belonging to the hospital, and make such reports as may be required by the Visiting and Examining Board or the Commandant.

MATRON

     The Matron shall have general supervision of the reception rooms, guest chambers, bedding, table linen, and apparel of all the members excepting employees not members of the Home. She shall keep a correct list of all articles under her care and report to the Adjutant when new articles are needed or old articles are discarded. She shall prepare a bill of fare for the kitchen each day, consulting with the Commandant and also the chief cook in regard to the most suitable and available dishes and courses to be served.

     She shall also visit the various apartments and departments of the Home from time to time, noticing the condition of each in regard to cleanliness and pleasantness, also the food and care given the invalids. She shall visit the cottages from time to time and report to the Commandant all irregularities that need correction which she may discover.

THE LIBRARY

     The Commandant shall appoint a librarian from among the members of the Home, whose duty it shall be to have the care and custody of the books, magazines, periodicals, and other literature of the library and reading room.

     He shall allow no books to be taken from the building without permission of the Commandant.

     He shall keep a record of each book taken from the library, date, and name of the party taking the same, and require that all books be returned at the specified time.

     Each member of the Home shall be entitled to the use of such books as he may select, the same to be returned in as good condition as when received within one week after the date of taking the same. If a book shall be wilfully damaged, destroyed, or lost, the circumstances shall be at once reported to the Commandant, who shall decide what action shall be taken in regard to said damage or loss.

     The library shall be open on between the hours of 2 and. 4 P.M., each day except Sunday, and at other times by consent of the Commandant or Librarian.

RULES OF THE HOME

     RULE 1. The authority of the Commandant will be exercised with firmness, kindness, and justice.

    RULE 2. Members of the Home shall conduct themselves at all times in a decorous and orderly manner, observing strict courtesy toward the officers and toward each other, and shall discharge such duties as may be required of them by the Commandant or subordinate officers with alacrity and good faith.

     RULE 3. At reveille the members shall rise, wash, and dress themselves neatly, and when assembled for breakfast the officer in charge will call the roll, inspect the men, note absentees, and report all irregularities to the Commandant.

     RULE 4. The Commandant shall order details made to assist the Matron from either men or women at her request.

     RULE 5. Complaints of ill treatment may be made direct to the Visiting and Examining Board, but must be made in writing and specific as to details.

    RULE 6. Profanity and vulgarity are forbidden, and quarrels among the members or employees will subject the offenders to punishment.

     RULE 7. No smoking will be allowed within the building except in the smoking room.

     RULE 8. Water, sweepings, or refuse of any kind shall not be thrown from the doors or windows of the buildings, but must be put in places designated by the Commandant.

     RULE 9. Marking on the walls is forbidden and defacing buildings, trees, fences, or grounds will not only subject the offender to punishment, but will render him liable to the Home for damages. 

     RULE 10. No member, unless assigned to such duty, shall at any time interfere with the furnaces, ranges, lights, sewers, or water-works of the Home.

     RULE 11. Members shall appear at all times in the uniform or dress established by the Board.

     The uniform shall be of dark blue material, with brass buttons bearing the insignia of the Home.

     RULE 12. After the first issue of clothing to a member of the Home, twenty-five dollars per year in value will be considered a sufficient amount for future issues, subject, however, to the judgment of the Commandant.

     RULE 13. The Commandant may grant passes under such restrictions as in his judgment may be required for the welfare of the Home, and no member shall leave the Home without his permission.

     RULE 14. Furloughs may be granted for thirty or sixty days, as the applicant may desire, and the same be extended on application, and all parties absent without leave shall be dropped from the rolls at the discretion of the Commandant, subject to the approval of the Visiting and Examining Board.

     RULE 15. Parties remaining on furlough for one year will not be considered as entitled to benefits of the Home, and will receive an Honorable Discharge when deemed advisable by the Board.

     RULE 16. Whenever the Visiting and Examining Board is satisfied that any member is able to earn a livelihood or has sufficient means of support, he or she may be discharged at their discretion.

     RULE 17. All discarded clothing shall be accounted for before others are issued, and a complete list of all clothing taken from the Hospital to the laundry shall be made, and the same checked off on return.

     RULE 18. Any member of the Home who, at time of death being in possession of pension or other money and having no dependent relative, so much of said money shall be used for defraying burial expenses as may be needed.

     RULE 19. No applicant shall be admitted to the Home who is drawing a pension of more than twelve dollars per month, unless in special cases, when the Visiting and Examining Board may in their judgment require the pensioner to pay to the Home all moneys in excess of the $12 per month.

     RULE 20. Persons admitted to the Home, having dependent families or relatives, and drawing pensions, shall turn over their pension checks to the Commandant for the use of such dependent families, and he shall forward the same to them, and if such person have no family or relatives and are members of the Home receiving compensation for labor therein, they shall provide their own tobacco, and in no case shall be issued more than four ounces of chewing and four ounces of smoking tobacco, or of either, per week to any one person.

DISCHARGES

     RULE 21. Any member will be allowed an honorable discharge on application, unless guilty of some gross misdemeanor, and may be readmitted on application and reexamination. For the following offenses members shall be dishonorably discharged, viz.: Using insulting and abusive language, violent and threatening conduct toward officers, fellow-members, or visitors, after having been reprimanded by the Commandant, or for repeated acts of disobedience, or for any gross or outrageous behavior.

     RULE 22. The Commandant, in addition to the above rule, may allow those so addicted to the use of intoxicants as to be troublesome and disorderly, the privilege of taking the "Alcoholic Treatment" instead of discharge. If pensioners, they shall turn over to him their pension checks until the expense of taking the "treatment" is paid.

PUNISHMENTS

     RULE 23. In order that these rules may be enforced and discipline and good order maintained, the Commandant is hereby authorized to administer the following punishment, viz.: (webmaster note: this rule was printed as #13, but sure it was 23.)

  • First--Reprimand, either public or private. 
  • Second--Extra duty on detail.
  •  Third--Confinement in the guardhouse.
  • Fourth--Suspension from the privileges of the Home for a period not to exceed sixty days.
  • Fifth--Suitable fines, to be paid either in money or labor, may be imposed in commutation of penalties decreed whenever the offender may so elect and the Commandant deem the same advisable.
  • Sixth--Expulsion from the Home, which must be approved by the Visiting and Examining Board.

     It shall be the duty of the Commandant to see that these rules are duly enforced and all offenders promptly corrected. 

AMENDMENTS

     These rules may be added to or amended at any regular meeting of the Board by a majority vote of all members present.
